On June 25, the State Engineer's Office (SEO) will kick-off the informal phase of the rulemaking authorized by House Bill 1303, whereby criteria for determining the tributary/non tributary status of oil and gas produced water will be established. This rulemaking will enter its formal phase in the fall of this year, with a goal of completing the process by around the end of the year. HB 1303 provides a "timeout" for the application of water well permitting and water rights administration to oil and gas wells until March 31, 2010. The Colorado Oil & Gas Association has organized a Produced Water Task Force for operators interested in this rulemaking.
