Evan joined Beatty and Wozniak, P.C. in 2016, and focuses his practice on regulatory and transactional matters.  He brings a diverse and extensive skill set to the firm, as well as a strong passion for the industry.   “A large part of my family is directly tied to oil and gas.  I know exactly how important energy development is to communities across the United States, let alone our economy as a whole.”  Upon emigrating from Norway, Evan’s family homesteaded the Williston Basin and still maintains a small farm with producing oil wells in Divide County, North Dakota.  Throughout college, Evan would spend summers in Williston working in the oil patch, undertaking everything from weed abatement to soil remediation.  After law school, Evan worked as a landman drafting NRI reports in Wyoming’s Green River and Powder River Basins. 


Before entering private practice, Evan worked for a leading U.S. bank and was solely responsible for the management of over 4,000 oil and gas assets scattered across the United States. During this time, Evan successfully negotiated multi-million dollar oil and gas leases in the DJ and Powder River Basins, and assisted with complex, multijurisdictional litigation, frequently traveling the country to inspect court-ordered well site reclamations.


Upon entering private practice, Evan began drafting Drilling and Division Order Title Opinions covering the Greater Wattenberg area of Weld and Adams County, Colorado.  Evan has since represented clients in regulatory matters, complex corporate work and estate administration specifically focused within the oil and gas sector.  Evan has immense experience probating estates for curative purposes and still routinely represents mineral owners seeking release of royalty income held in suspense. 


Prior to transitioning into oil and gas, Evan practiced tax law, where he represented clients before the IRS Office of Appeals and assisted in litigating complex tax liabilities before the United States Tax Court.



  • Completed vast contractual risk analysis and assessment in support of multiple, large asset acquisitions and divestitures.

  • Negotiated and drafted joint operating agreements, letter agreements, purchase and sale agreements, farmout agreements, surface use agreements and various midstream agreements.

  • Reviewed extensive mechanical and machinery based proposals and advised midstream clients accordingly.

  • Assessed and advised clients as to current and future ownership interests and obligations subsequent to asset exchange agreements.

  • Drafted various asset conveyance instruments, including state, federal and fee oil and gas lease assignments.

  • Represented clients in joint surface use agreements, right-of-way easements, right of entry licenses and reclamation waiver agreements.


  • Drafted and submitted notices, statutory pooling applications, drilling and spacing unit applications, increased well density, reduced setbacks and various other applications before the Colorado Oil and Gas Conservation Commission.

  • Consulted and advised clients concerning local and state ordinances, potential impacts and associated fees.

  • Represented clients contesting matters before the COGCC, draft protests, motions to dismiss and responses associated therewith.

  • Prepared research memorandum and advised on client circumstances, including unit creation, large-scale facility development, easement ownership, pooling declarations and executive rights.



  • Advised and represented clients regarding SEC obligations, including 8-K, 10-K and 10-Q reports.

  • Counseled clients as to oil and gas asset security classifications, federal broker/dealer registration requirements and blue-sky laws.

  • Drafted various corporate governance instruments, including operating agreements, by-laws, actions by written consent, common unit purchase and pledge agreements, confidentiality and nondisclosure agreements, letters of transmittal and dissolution documents.



  • Rendered limited, acquisition, supplemental, drilling and division order title opinions.

  • Drafted mineral and working interest reports, chain of title assessments, ORRI burdens and apportionments.

  • Federal lease file and unit review, including status, operating rights, record title and encumbrance analysis.


Estate Administration / Probate

  • Represented clients regarding will, trust and estate administration.

  • Administered probate proceedings, small estate affidavits and affidavits of heirship.

  • Effectuated the release of royalty income held in suspense.



  • Analyzed case law supporting client positions concerning tax deficiencies and liabilities.

  • Examined Internal Revenue Code and Treasury Regulations to contest and undermine IRS incongruities.

  • Drafted pre-trial motions and other pleading documentation.
