OVERVIEW

Nicole joined Beatty & Wozniak as Senior Counsel in 2017.  She brings 12 years of experience specializing in environmental, health, and safety law as they apply to oil and gas exploration and production, business transactions, real estate development, and other commercial operations.  Her practice focuses on advising clients with respect to waste, water, and safety and health matters. 

 

Nicole’s experience includes:

 

  • Defending alleged violations of RCRA, CERLCA, the Clean Water Act, and the Occupational Safety and Health Act;

  • Permitting;

  • Responding to information requests;

  • Spill reporting and response;

  • Responding to compliance advisories and notices of alleged violations;

  • Remediation;

  • Hazardous materials transportation;

  • Underground storage tanks;

  • Environmental due diligence;

  • Compliance audits.

 

Earlier in her career, Nicole was a prosecutor in the Colorado Attorney General’s Office where she enforced environmental laws.  She also gained substantial litigation experience working as an in-house attorney for a large insurance company.

 

Nicole enjoys traveling, running, and spending time with her family, including her German Shepherd.

 

SELECT EXPERIENCE

Litigation

  • Defended oil and gas clients and others against U.S. EPA administrative litigation alleging violations of the Clean Water Act.

  • Prosecuted multi-day hearing to enjoin violations of the Colorado Solid Wastes Disposal Sites and Facilities Act.

  • Defended personal injury jury trials.

  • Defended personal injury and property damage bench trials.

Regulatory

  • Responded, on behalf of oil and gas clients and others, to various information requests pursuant to CERCLA, the Clean Water Act, and the Clean Air Act.

  • Defended oil and gas client and others against alleged violations of the Occupational Safety and Health Act.

  • Defended oil and gas client against alleged violations of COGCC’s flowline rules.

  • Advised oil and gas clients regarding spill reporting.

  • Assisted with environmental due diligence for the purchase of a partially constructed pipeline.

  • Led corporation-wide hazardous materials transportation audit including several refineries.

  • Drafted environmental self-disclosure letter for oil and gas client.

  • Advised oil and gas clients and others regarding water discharges.

  • Negotiated $450,000 property damage settlement and remediation agreement resulting from the negligent release of petroleum from an underground storage tank.

  • Led real estate developer through Voluntary Cleanup Program application process paving the way for residential redevelopment of a historic foundry.

  • Advised dry cleaners regarding the investigation and remediation of PCE releases.

Transactional

  • Advised various clients regarding environmental due diligence for real estate and other asset transactions.

  • Analyzed potential risks of lending on contaminated properties.

  • Drafted lease provisions addressing compliance with underground storage tank regulations.

  • Drafted environmental disclosures and indemnities for business contracts.
