Jill Fulcher focuses her practice with Beatty & Wozniak on representing companies before the Colorado Energy & Carbon Management Commission (ECMC). Her reputation with the ECMC is unmatched, and she has successfully obtained Commission approval for hundreds of requests for relief pertaining to drilling and spacing units, Oil and Gas Development Plans, increased well density, reduced setbacks, statutory pooling, and unitization. 

Jill also has success representing clients at the ECMC for contested matters related to horizontal wellbore spacing units, APD approvals, unconventional resource units, and enhanced recovery operations. Additionally, she has represented clients before the ECMC for nearly every major rulemaking in the last decade. 

In addition, Jill assists clients in navigating local and federal regulations. She assists clients with local permitting and transportation access issues, as well as obtaining surface locations. Jill has helped companies enter Memoranda of Understanding with local governments and assisted clients in defending cases before the Interior Board of Land Appeals.

Representative Experience

  • Represented and advised individual companies and trade associations in multiple rulemakings before the ECMC, including flowline rulemaking, produced water rulemaking, pooling rulemaking, and other hearings required following the passage of Colorado Senate Bill 2019-181;  
  • Obtained favorable results in numerous contested adjudicatory hearings in Colorado, including highly technical cases pertaining to operatorship and development disputes, enhanced oil recovery operations, unitization for primary recovery operations, and compulsory pooling of local governments;  
  • Provided testimony on behalf of trade associations during Colorado 2017 and 2018 legislative sessions;  
  • Advised clients and worked with the ECMC concerning various carbon sequestration issues in Colorado, including applicable regulatory structure while Colorado pursues Class VI injection primacy; 
  • Advised numerous clients on the application of Colorado’s revised financial assurance requirements following year-long rulemaking, including single well financial assurance plans, asset retirement plans, and asset-specific variances;  
  • Worked with ECMC regulators on language in statewide order exempting stratigraphic wells drilled for carbon capture and sequestration testing from Colorado’s Oil and Gas Development permit requirements; 
  • Represented top Colorado oil and gas producer in securing approval of landmark huff-and-puff injection operation; 
  • Represented numerous companies before the ECMC in securing favorable approvals of Class II injection operations; and 
  • Secured approval of largest Oil and Gas Development Plans in Colorado for top oil and gas producer.
