Our attorneys advise companies on access to federal lands for energy development, including all aspects of oil and gas leasing, exploration, and permitting involving federal and tribal minerals.  They also counsel companies on a variety of infrastructure and renewable energy projects on federal and tribal lands, including rights-of-way, federal land access and project permitting.  In this role, our attorneys focus on efficiently navigating the federal political and permitting processes and doing so in a manner that also minimizes litigation risk.

Federal Lands, Leasing, and Development

Our attorneys engage federal regulators and political leaders at numerous federal agencies, including the U.S. Department of the Interior, Bureau of Land Management (BLM), U.S. Fish and Wildlife Service (FWS), U.S. Forest Service, Environmental Protection Agency (EPA), U.S. Army Corps of Engineers, and the Federal Energy Regulatory Commission to advocate in support of our clients’ business and project goals.

We also engage and seek the support of state agencies, local officials, advocacy organizations, and federal legislators regarding federal policy and regulatory issues.

Our federal practice attorneys specialize in front-end regulatory counseling regarding federal oil and gas leasing and permitting projects with the Bureau of Land Management and the U.S. Forest Service. In this role, we work with companies to facilitate federal lease issuance, as well as structure siting, permitting and environmental documentation to facilitate efficient project authorizations and permit approvals, while at the same time minimizing litigation risk from anti-development organizations.

We also guide our clients through species management issues at the federal and state levels, including issues involving endangered, threatened, and sensitive species, such as the greater sage grouse and the lesser prairie chicken as well as addressing migratory bird, big game, and other species issues.

Our attorneys routinely represent companies in federal courts and administrative litigation before the Interior Board of Land Appeals and U. S. Forest Service. We represent clients in legal proceedings related to federal leasing, seismic survey permits, oil and gas development projects, rights-of-way, royalty payments and disputes, drilling permits, and compliance with the myriad of federal statutes. We also work with clients confronted with federal investigations, subpoenas, and enforcement proceedings.
